Introduction

These terms govern use of the octomize-agency.com website. Octomize (“Agency”) provides digital advertising and marketing services. By using this website you agree to these terms. Octomize may update these terms without notice. You should review these terms each time you use the website. If you continue to use the site after changes, your continued use means acceptance of the updated terms.

Intellectual Property

All content and materials on this website are protected by copyright, trademark and other rights. You agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, display, perform, publish, adapt, edit or create new works from our content without written permission. Reproduction or distribution of materials or design elements for commercial purposes is prohibited without written consent.

Eligibility and Access

You must be eighteen or older to access this website. If a password is issued, use the password only for personal access. You are responsible for security of your password.

Services

Octomize provides end-to-end digital growth services including paid media management across platforms including Google Ads and Meta Ads, tracking and measurement setup (GA4, GTM, server-side tracking, Enhanced Conversions, Meta Conversions API), landing page creation and conversion rate optimization (CRO), offer optimization, profit-focused reporting and business growth support. A free Profit Growth Plan - including a comprehensive audit and strategic recommendations - is provided before any engagement begins, with no obligation. Campaign management covers the creation and optimization of advertisements, landing pages, tracking infrastructure and all related deliverables. Deliverables, including creatives and landing pages, become the property of the client once outstanding invoices are paid. Third-party software or platform fees may be necessary for access to certain tools or deliverables.

Fees and Payments

Octomize offers three pricing structures, agreed upon before the engagement begins based on the scope of work: (1) a flat monthly fee based on the complexity and volume of work; (2) a flat monthly fee combined with a percentage of revenue or profit generated; or (3) a percentage of revenue or profit generated only. All services included in the agreed scope - such as campaign management, tracking setup, landing page creation and optimization - are covered by the selected pricing model. There are no separate setup fees. Technology fees for third-party platforms are disclosed and billed to the client when applicable. All fees and ad spend use the currency of the client’s advertising account. Payment is due within thirty days of invoice date.

Client Obligations

Clients provide timely access to advertising accounts, website analytics, product details and brand guidelines. Clients maintain a valid payment method for advertising spend and fees and cooperate by providing approvals for creative deliverables.

Termination

Either party may terminate services with fourteen days’ written notice. Upon termination the client remains liable for fees earned and costs incurred through the termination date, including advertising spend and technology fees.

This website may link to other sites on the internet. Those sites might contain information or material some people find inappropriate or offensive. The Agency does not control or endorse those sites and is not responsible for their content.

Information You Submit

You warrant that information you submit through the website belongs to you and that you have authority to provide it. You grant Octomize a royalty-free, perpetual, worldwide licence to display, modify, adapt and create derivative works from suggestions, ideas or information you provide. Do not submit content that is obscene, vulgar, pornographic or encourages unlawful acts; that infringes third-party rights; or that is offensive or inappropriate.

Privacy and Data Protection

Octomize respects your privacy. We handle personal data in accordance with the General Data Protection Regulation (GDPR) and applicable Bulgarian law. We use dedicated email addresses and secure project management systems to protect communications.

Disclaimer of Warranties

All materials, information, software, products and services available through this website are provided “as is” for your use. Content is provided without express or implied warranties. Octomize does not guarantee accuracy, reliability or correctness of the content; availability of the website at any particular time; correction of defects; or that the content is free of viruses or harmful components. Advertising results depend on many factors outside Octomize’s control, including market conditions, client budgets, product-market fit and third-party platform changes. Octomize does not guarantee specific performance outcomes, revenue targets or return on ad spend.

Limitation of Liability

Under no circumstances will Octomize, its agents, affiliated companies, officers, directors, employees or contractors be liable for any direct, indirect, punitive, incidental, special or consequential damages arising from the use or inability to use this website. For services, total liability does not exceed the fees paid by the client during the three months preceding a claim.

Indemnification

You agree to defend and indemnify Octomize and its affiliates, employees, contractors, officers and directors from all liabilities, claims and expenses, including attorney fees, arising from misuse of this website or violation of these terms.

Severability and Integration

This agreement constitutes the entire agreement between you and Octomize regarding use of this website. If any part of these terms is held invalid, the remaining portions continue in full force.

Governing Law and Jurisdiction

These terms are governed by and construed in accordance with the laws of Bulgaria and applicable European Union law. You consent to the exclusive jurisdiction of the courts in Sofia, Bulgaria for any disputes arising from these terms.
